Simultaneous moderation and commenting

Hello,

I have been sick the last few days and bored enough to make this inquiry. I am curious as to what the consequences are for a mod who breaks this rule:

I encountered it the other day – a mod was simultaneously commenting in the thread and at the same time attempting to moderate. When I mentioned the rule-breaking, the moderator chose not to address the fact that he was actively breaking the rules of moderation.

What happens in this case? A moderator can give a commenter a 3-day ban – does a moderator get a similar punishment for such a move? I am curious.
